Terms and Conditions for Instagram Giveaways

1. Scope/Release of Instagram from Liability

These terms and conditions apply to all giveaways we run through the Instagram profile “cardcusmos.com”.

The giveaway is organized by cardcosmos GmbH, Bremland 34, 24857 Fahrdorf.

This promotion is not affiliated with Instagram and is in no way sponsored, endorsed, or organized by Instagram. All information relating to the giveaways is provided solely by cardcosmos GmbH as the organizer of the giveaway.

2. Eligibility Requirements

By entering the giveaway, participants expressly accept these terms and conditions.

Both customers and non-customers of cardcosmos GmbH are eligible to participate.

Employees of cardcosmos GmbH and their relatives are not eligible to participate.

The giveaway begins when the post is published on our Instagram profile. Entries are accepted only until the specified drawing time. Please refer to the details in the relevant giveaway post on our Instagram profile for the applicable times.

The exact entry procedures will be stated in the caption of the relevant giveaway post. For example, participants may enter by liking or commenting on a post, following the profile, sharing the post, or taking part in similar interactions.

3. Prizes/Selection of Winners/Prize Delivery

The prize will be specified in the relevant giveaway post. Only non-cash prizes are offered. Cash payment of the prize value and exchanges are not permitted. The right to the prize is non-transferable.

Winners are generally selected at random immediately after the giveaway ends. For estimation questions, the participants whose answers come closest to the actual result win. In the event of a tie, the winner among the tied participants will be selected by drawing lots. Winners will be notified by direct message on Instagram. Each winner must respond by Instagram message within 4 business days. If no response is received within this period, the right to the prize is forfeited and a new winner will be selected.

Prizes are delivered by shipping and/or collection at a cardcosmos Store. Further details will be announced in the giveaway post.

4. Data protection

To conduct the prize draw, cardcosmos GmbH processes participants’ personal data. This may include, in particular, Instagram usernames, interactions posted publicly as part of participation (e.g., comments), and, for winners, contact details required for notification and prize delivery.

The data is processed exclusively for the purpose of conducting the prize draw, in particular to verify eligibility, determine the winners, notify the winners, and deliver the prizes. The legal basis is Art. 6(1)(b) GDPR. Data collected as part of the prize draw will not be used for further advertising purposes without a separate legal basis or, where required, separate consent.

Participants’ data will be deleted no later than 30 days after the end of the prize draw, unless statutory retention or documentation obligations apply. However, comments on Instagram will remain and continue to be publicly visible.

The controller within the meaning of the GDPR is cardcosmos GmbH, Bremland 34, 24857 Fahrdorf.

Participants may withdraw their consent to the use of their personal data at any time. The withdrawal must be submitted in writing to the address of cardcosmos GmbH listed in the legal notice. After consent is withdrawn, the personal data collected and stored will be deleted immediately. Participation in the prize draw will then no longer be possible.

5. Early termination of the prize draw

The organizer reserves the right to change the components of the prize draw without prior notice, cancel or end the prize draw due to unforeseen circumstances. This applies in particular if software and/or hardware errors occur and/or other technical and/or legal reasons affect or make impossible the regular and proper conduct of the prize draw.

6. Other

Legal recourse is excluded. German law applies exclusively. Should any of these provisions be or become invalid, the validity of the remaining terms and conditions of participation shall remain unaffected. These terms and conditions of participation may be amended by cardcosmos GmbH at any time without separate notice.
